Tire Blamed For Deadly Car Accident

A recent article on the Big Country Homepage states that a tire may be the cause of a crash that took the life of one person and injures two others. The accident occurred on Monday night on I-20 just east of Colorado City. Clemente Gallegos Ramos, a 51-year-old man from Dallas, was pronounced dead at the scene of the wreck at around 6:30 p.m. According to the DPS report, one of the tires on Ramos’ truck lost its tread and this caused the truck to skid into a guardrail and flip over onto its top. Two passengers who were inside the vehicle were taken to the hospital but their conditions are unknown. However, the DPS report stated that one of the passengers was in serious condition when they were taken away.

Defective Products

When people think about dangerous products, they may not typically think about tires being one of the things that can be dangerous when they are defective. As demonstrated in the article above, blowouts while driving can have deadly results. Other products like car seats, airbags, power tools, and children’s toys seem to have found the most media coverage when it comes to product recalls here lately. The sad and perhaps scary thing is that almost any product can become dangerous.

What Constitutes a Defective Product?

There are several factors in determining if something that was produced is defective. If the item does not come with a proper warning, it can be considered dangerous and the manufacturer might be liable for any damages. Also, if there is a design flaw or manufacturing defect that is either overlooked or allowed to pass inspection. A product is in a defective condition if it is unreasonably dangerous to the user or to the consumer who purchases the product and causes physical harm. Some products are dangerous in their intentional design like chainsaws and firearms and so their manufacturers and distributors may contest that it was a misuse of the product that led to an injury. However, these types of products are still capable of having design flaws that lead to unintentional injury, as well.

Because this is an intricate subject matter, it may be in your best interest to seek the advice of a professional attorney if you have been harmed by something you have bought. Injuries can lead to unexpected bills and costs that you may not have to pay for yourself. If the product is dangerous enough, you may even lose a loved one in the accident. This loss can be devastating to a family and can cast some doubt on their future.
